The Most Expensive Place to Get Divorced

Leading the list is Washington, D.C., where the average divorce costs couples more than $20,700. High attorney rates are the biggest reason, with family lawyers charging an average of $492 per hour — the highest in the nation.

The study also notes that Washington, D.C. follows “equitable distribution” laws, meaning judges determine how assets are divided rather than automatically splitting everything 50/50. That can lead to longer negotiations and higher legal fees.

California also requires couples to wait 180 days before finalizing their divorce, one of the longest waiting periods in the country.

The Cheapest State for Divorce

On the opposite end of the spectrum is West Virginia, where divorce costs are significantly lower. Attorneys there charge under $200 per hour on average, making divorce roughly 30% cheaper than in many other states.

“A contested divorce in D.C. or New York can go as high as $60K or $80K once you add in depositions, expert witnesses, and multiple court appearances.”
